Terms of Service

Terms of Service

OVERVIEW

This website is operated as GripReady. Throughout the website, the terms “GripReady,” “we,” “us,” and “our” refer to the operator of the GripReady online store.

GripReady provides this website, including its information, product listings, features, tools, and services, subject to your acceptance of these Terms of Service and the policies referenced within them.

By visiting gripready.com, creating an account, submitting information, or purchasing a product, you agree to be bound by these Terms of Service.

These Terms apply to all visitors and users of the website, including browsers, customers, purchasers, content contributors, and individuals acting on behalf of an organization.

Please read these Terms carefully before using the website. If you do not agree with these Terms, you should not access the website, create an account, or purchase products through GripReady.

Additional policies published on the website, including the Privacy Policy, Shipping & Delivery Policy, and Return & Refund Policy, form part of these Terms.

Nothing in these Terms is intended to exclude or restrict any consumer right or legal protection that cannot lawfully be excluded or restricted.

SECTION 1 – ELIGIBILITY AND ONLINE STORE TERMS

By using the website or placing an order, you represent that:

  • You have reached the age of legal majority in your place of residence; or

  • You are using the website with the permission and supervision of a parent or legal guardian; and

  • You have the legal capacity and authority to enter into a binding purchase agreement.

Products intended for adult installation, climbing training, or potentially hazardous activities should not be purchased or used by minors without appropriate adult supervision.

You may not use the website or any product purchased from GripReady for an illegal, unauthorized, fraudulent, or harmful purpose.

You are responsible for complying with all laws, regulations, facility rules, building requirements, and safety requirements applicable to your location and intended product use.

SECTION 2 – CLIMBING AND BOULDERING RISK

Climbing, bouldering, strength training, finger training, grip training, and the installation or use of climbing-related products involve inherent risks.

These risks may include:

  • Falls

  • Impact injuries

  • Finger, hand, wrist, elbow, shoulder, or tendon injuries

  • Cuts, abrasions, blisters, and skin damage

  • Equipment failure

  • Improper installation

  • Structural failure

  • Overtraining

  • Serious bodily injury

  • Permanent disability

  • Death

No product, product description, website article, customer service response, review, photograph, video, or other website content can eliminate these risks.

Customers are responsible for assessing their own experience, physical condition, environment, equipment, and ability before participating in climbing or training activities.

Beginners should obtain instruction from an appropriately qualified climbing instructor or experienced supervisor before using unfamiliar equipment or attempting unfamiliar training exercises.

Use appropriate supervision, spotting techniques, landing surfaces, protective equipment, and facility safety procedures where applicable.

SECTION 3 – SAFETY-CRITICAL AND LOAD-BEARING PRODUCTS

A product must not be used for belaying, fall arrest, suspension, rescue, life support, personal protective equipment, anchoring, or any other safety-critical or load-bearing purpose unless the product listing and manufacturer documentation expressly state that it is designed and certified for that specific purpose.

Products such as:

  • Training holds

  • Grip trainers

  • Hangboards

  • Pull-up accessories

  • Resistance equipment

  • Storage carabiners

  • Accessory clips

  • Display hooks

  • Equipment organizers

  • Decorative climbing products

must not be assumed to be suitable for life-safety use merely because they resemble professional climbing equipment.

Customers must review the product label, technical specifications, manufacturer instructions, certifications, warnings, weight limitations, and intended-use information before use.

Website titles, search categories, photographs, customer reviews, and general descriptions do not override the manufacturer’s instructions or the physical product labeling.

Never use a product for a safety-critical purpose when its certification, condition, history, compatibility, or intended use is uncertain.

SECTION 4 – INSTALLATION AND STRUCTURAL SAFETY

Certain GripReady products may require installation, mounting, drilling, anchoring, assembly, or attachment to a wall, ceiling, door frame, beam, training structure, or other surface.

Customers are responsible for confirming that:

  • The installation surface is structurally suitable

  • The structure can withstand the expected static and dynamic forces

  • The correct anchors, bolts, screws, brackets, and mounting components are used

  • All components are compatible

  • Installation follows the manufacturer’s instructions

  • Required clearances and landing areas are maintained

  • The product is inspected before each use

  • Loose, worn, damaged, or corroded parts are replaced

Fasteners included with a product may not be appropriate for every wall, ceiling, or structural material.

Professional installation should be obtained when the customer does not have the knowledge, tools, or experience necessary to confirm structural safety.

GripReady does not inspect the customer’s building, training area, installation surface, hardware selection, or completed installation.

A product should not be used when installation is incomplete, unstable, damaged, incorrectly positioned, or inconsistent with the manufacturer’s instructions.

SECTION 5 – TRAINING AND OVERUSE

Climbing training products may place significant stress on fingers, tendons, joints, muscles, and connective tissue.

Customers should:

  • Begin gradually

  • Use appropriate warm-up and rest periods

  • Avoid sudden increases in intensity

  • Stop training when experiencing sharp pain, numbness, weakness, swelling, or unusual discomfort

  • Avoid using damaged or unstable equipment

  • Follow any product-specific training guidance

  • Consult an appropriately qualified professional when uncertain about safe training

Training results vary by individual. GripReady does not guarantee improvements in grip strength, climbing grade, endurance, recovery, injury prevention, or athletic performance.

Product descriptions and training-related content are provided for general informational purposes and are not individualized coaching, medical advice, physical therapy, rehabilitation advice, or injury diagnosis.

SECTION 6 – HAND AND SKIN CARE PRODUCTS

Hand-care, skin-care, tape, balm, salve, cream, chalk, liquid chalk, adhesive, cleaning, or recovery products may contain ingredients that cause irritation or allergic reactions in some individuals.

Before using a product:

  • Review the ingredient information

  • Follow the manufacturer’s instructions

  • Perform a small patch test where appropriate

  • Avoid use on areas prohibited by the product instructions

  • Avoid contact with eyes and other sensitive areas

  • Keep products away from children and animals

  • Stop use if irritation or an adverse reaction occurs

Seek appropriate medical assistance for a serious or persistent reaction.

GripReady does not diagnose or treat medical conditions. Hand-care products are not substitutes for professional medical treatment unless expressly approved and labeled for that purpose by the appropriate regulatory authority.

Customers with allergies, existing skin conditions, open wounds, infections, circulatory problems, or other health concerns should consult an appropriately qualified healthcare professional before using a product when necessary.

SECTION 7 – PRODUCT INSPECTION AND MAINTENANCE

Customers must inspect products before installation and before each use.

Do not use a product that shows signs of:

  • Cracking

  • Fraying

  • Unusual stretching

  • Deformation

  • Corrosion

  • Loose components

  • Missing parts

  • Damaged stitching

  • Worn attachment points

  • Chemical contamination

  • Heat damage

  • Unauthorized modification

  • Any condition that creates uncertainty regarding safety

Products should be cleaned, maintained, stored, and replaced according to the manufacturer’s instructions.

Normal appearance does not guarantee that a product is safe. Some forms of wear, internal damage, aging, contamination, or material degradation may not be visually obvious.

Customers are responsible for maintaining appropriate inspection and replacement practices for the products they use.

SECTION 8 – RECALLS AND SAFETY NOTICES

Customers should immediately stop using a product that is subject to a recall, stop-use warning, safety notice, or manufacturer correction.

GripReady may contact customers using the email address or contact information provided with an order when we become aware of a relevant safety notice.

Customers are responsible for keeping their order contact information accurate and reviewing safety communications relating to their products.

Recall remedies may be provided by GripReady, a distributor, supplier, manufacturer, or government authority depending on the circumstances.

Customers must follow the specific instructions included in the applicable recall or safety notice.

SECTION 9 – GENERAL CONDITIONS

We may refuse, restrict, suspend, or cancel access to the website or an order for lawful reasons, including:

  • Suspected fraud

  • Unauthorized payment activity

  • Website abuse

  • False account information

  • Prohibited product use

  • Export or destination restrictions

  • Threatening or abusive conduct

  • Attempts to interfere with website security

  • Material violation of these Terms

We will not refuse service for an unlawful discriminatory reason.

We may impose reasonable purchasing limits, account restrictions, or verification requirements to protect customers, prevent fraud, comply with laws, or manage limited inventory.

SECTION 10 – ACCOUNT INFORMATION

Some website features may permit or require customers to create an account.

Customers are responsible for:

  • Providing accurate information

  • Maintaining the confidentiality of login credentials

  • Restricting unauthorized account access

  • Updating account and contact information

  • Notifying us of suspected unauthorized activity

You may not impersonate another person, create an account using false information, or use another person’s account without authorization.

GripReady may suspend an account when reasonably necessary to investigate security, fraud, payment, or policy concerns.

SECTION 11 – PRODUCT INFORMATION

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, materials, compatibility information, and specifications.

However:

  • Display colors may vary by monitor or device

  • Measurements may contain reasonable manufacturing tolerances

  • Packaging may change

  • Manufacturers may make non-material design updates

  • Natural or handmade materials may vary

  • Product images may include demonstration items not included with the purchase

Customers should review the full product listing before ordering.

A minor difference that does not materially affect a product’s function may not constitute a defect. This does not apply when a product is materially different from its description or applicable law provides otherwise.

If product information conflicts with the manufacturer’s label, instructions, safety warning, or certification, customers should stop using the product and contact us for clarification.

SECTION 12 – PRODUCT AVAILABILITY

Products may have limited availability and may become unavailable after an order is submitted.

Adding a product to a shopping cart does not reserve inventory.

We may limit product quantities per person, household, account, payment method, or order when reasonably necessary.

If an ordered product becomes unavailable, we may:

  • Cancel the affected product

  • Contact the customer regarding an available alternative

  • Offer a revised fulfillment timeframe

  • Issue a refund for the unavailable product

We will not substitute a materially different product without the customer’s agreement.

SECTION 13 – PRICES, TAXES, AND CURRENCY

Product prices may change without notice before an order is submitted.

The price charged will generally be the price displayed during checkout, subject to correction of genuine errors and applicable law.

Applicable taxes, shipping charges, customs duties, and other charges will be handled as described during checkout or in the applicable store policies.

Unless otherwise displayed, prices on the website are generally presented in United States dollars.

When a customer uses a different currency, the payment provider, bank, card issuer, or currency-conversion service may apply:

  • Currency conversion rates

  • Foreign transaction charges

  • Processing fees

  • Other financial institution charges

These third-party charges are not controlled by GripReady.

SECTION 14 – PRICING AND LISTING ERRORS

The website may occasionally contain typographical errors, incorrect prices, inaccurate inventory information, incomplete descriptions, or other administrative or technical mistakes.

When a material error affects an order, we may contact the customer to:

  • Confirm corrected information

  • Offer the product at the correct price

  • Cancel the affected product

  • Provide an alternative

  • Issue an appropriate refund

We will not knowingly complete an order using materially misleading information.

If payment has already been collected for a canceled product, the applicable amount will be refunded.

SECTION 15 – ORDERS AND ORDER ACCEPTANCE

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.

We may review an order for:

  • Product availability

  • Payment authorization

  • Address accuracy

  • Destination restrictions

  • Suspected fraud

  • Pricing errors

  • Purchase limits

  • Compliance with these Terms

An order may be declined or canceled before shipment for a lawful and reasonable reason.

When an order is canceled after payment, we will issue an appropriate refund for the canceled and unshipped product.

GripReady may retain records reasonably necessary to document orders, refunds, cancellations, fraud reviews, and customer communications in accordance with the Privacy Policy.

SECTION 16 – PAYMENT

Customers represent that they are authorized to use the payment method submitted with an order.

Payments may be processed by third-party payment providers.

GripReady does not control every action, delay, decline, authorization hold, currency conversion, or security procedure imposed by a payment provider or financial institution.

An order may be delayed or canceled if:

  • Payment is declined

  • Authorization cannot be verified

  • Information is inconsistent

  • The payment provider identifies elevated risk

  • Additional verification is reasonably required

Customers must not use stolen, unauthorized, fraudulent, or unlawfully obtained payment information.

SECTION 17 – SHIPPING AND DELIVERY

Order processing, shipping fees, delivery estimates, tracking, customs charges, delayed packages, incorrect addresses, lost shipments, and delivery claims are governed by the GripReady Shipping & Delivery Policy.

Shipping and delivery dates are estimates unless a guaranteed service is expressly identified and confirmed.

If we cannot ship within a promised timeframe, we will provide the notice and options required by applicable law, which may include consent to a revised shipping date or cancellation and refund of the unshipped product.

Customers are responsible for providing complete and accurate delivery information.

SECTION 18 – RETURNS, REFUNDS, AND CANCELLATIONS

Returns, exchanges, refunds, damaged products, incorrect products, cancellations, and non-returnable items are governed by the GripReady Return & Refund Policy.

Submitting a return, cancellation, refund, or exchange request does not automatically mean that the request has been approved.

Products should not be returned until the customer receives the applicable return instructions.

Nothing in the Return & Refund Policy limits a mandatory consumer right that cannot legally be excluded.

SECTION 19 – CUSTOMER REVIEWS AND USER CONTENT

Customers may be permitted to submit reviews, photographs, videos, comments, questions, suggestions, or other content.

Submitted content must:

  • Reflect the contributor’s honest experience or opinion

  • Not be knowingly false or misleading

  • Not impersonate another person

  • Not contain unlawful threats or harassment

  • Not infringe intellectual property or privacy rights

  • Not contain malware, harmful code, or fraudulent links

  • Not disclose another person’s sensitive information without permission

GripReady may moderate or remove content that violates these standards, is unrelated to the product, contains spam, or is otherwise unlawful.

GripReady will not prohibit or penalize a customer merely for providing an honest negative review.

Where a review or endorsement is connected to a free product, payment, discount, affiliate relationship, sponsorship, employment, family relationship, or another material benefit, that connection must be clearly disclosed where required.

By voluntarily submitting content to GripReady, you grant us a non-exclusive, worldwide, royalty-free license to store, reproduce, display, format, and use that content for operating and promoting the store, subject to applicable law and our Privacy Policy.

You represent that you have the necessary rights to submit the content.

This license does not transfer ownership of your original content to GripReady.

SECTION 20 – INTELLECTUAL PROPERTY

Website content owned by or licensed to GripReady, including logos, graphics, product-page layouts, written materials, photographs, videos, icons, and website design, is protected by applicable intellectual property laws.

You may use the website for personal, lawful shopping and informational purposes.

Without appropriate permission, you may not:

  • Reproduce substantial website content

  • Sell or commercially exploit website content

  • Remove ownership notices

  • Use GripReady branding in a misleading manner

  • Create a false affiliation with GripReady

  • Copy protected product photographs or written content

  • Use automated systems to extract substantial website data

  • Interfere with website functionality

Nothing in these Terms transfers ownership of GripReady intellectual property to the user.

Third-party trademarks and brand names remain the property of their respective owners.

SECTION 21 – THIRD-PARTY PRODUCTS, TOOLS, AND LINKS

The website may contain third-party services, payment tools, shipping tools, applications, links, content, or products.

Third parties operate independently and may have their own terms and privacy practices.

GripReady does not control every third-party website or service.

Customers should review the applicable third-party terms before providing information or completing a transaction through an external service.

A link or integration does not necessarily mean that GripReady endorses every statement, practice, product, or service offered by that third party.

This section does not remove responsibility that applicable law places directly on GripReady.

SECTION 22 – PRIVACY AND ELECTRONIC COMMUNICATIONS

Personal information is handled according to the GripReady Privacy Policy and applicable law.

By placing an order or contacting us, you agree to receive transactional communications reasonably necessary to:

  • Confirm an order

  • Provide shipping updates

  • Respond to inquiries

  • Process a return or refund

  • Request necessary verification

  • Provide safety or recall information

  • Communicate policy or account matters

Transactional communications are separate from marketing communications.

Marketing messages will be sent and managed in accordance with applicable consent and unsubscribe requirements.

SECTION 23 – PROHIBITED USES

You may not use the website:

  • For illegal or fraudulent activity

  • To violate intellectual property rights

  • To submit false order or payment information

  • To distribute malicious software

  • To interfere with website security

  • To obtain unauthorized access to accounts or systems

  • To collect personal information unlawfully

  • To submit deceptive reviews

  • To impersonate another individual or organization

  • To evade purchase limits or fraud controls

  • To harass, threaten, or abuse customers or staff

  • To purchase products for a prohibited or unlawful end use

  • To violate export, customs, sanctions, or import laws

We may take reasonable action to prevent, investigate, or respond to prohibited activity.

SECTION 24 – INFORMATIONAL AND MEDICAL DISCLAIMER

Website information concerning climbing, bouldering, training, grip strength, skin care, recovery, installation, or product use is provided for general informational purposes.

It is not a substitute for:

  • Professional climbing instruction

  • Structural engineering advice

  • Medical diagnosis

  • Medical treatment

  • Physical therapy

  • Rehabilitation advice

  • Emergency services

  • Individualized athletic coaching

Customers should consult an appropriately qualified professional when their circumstances require specialized advice.

No website content creates a professional, medical, coaching, engineering, or instructor-client relationship.

SECTION 25 – DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis.

We do not guarantee that:

  • The website will always operate without interruption

  • Every error will be corrected immediately

  • Every product will remain available

  • Website content will be suitable for every individual purpose

  • Use of a product will produce a particular athletic result

  • All third-party services will operate without delay or error

Product warranties, if any, may be provided separately by the product manufacturer or expressly stated on the product page.

Nothing in this section excludes:

  • A warranty expressly provided in writing

  • A statutory warranty

  • Liability for a materially misdescribed product

  • Liability that cannot legally be excluded

  • Mandatory consumer protections

SECTION 26 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GripReady will not be responsible for indirect, incidental, special, consequential, or purely economic losses that were not reasonably foreseeable and that result from:

  • Misuse of a product

  • Unauthorized modification

  • Improper installation

  • Failure to follow warnings or instructions

  • Use outside the product’s intended purpose

  • Use of a non-safety-rated product for life-safety purposes

  • Failure to inspect or maintain a product

  • Reliance on general informational content as professional advice

  • Events outside our reasonable control

This limitation does not exclude or restrict liability for:

  • Fraud or fraudulent misrepresentation

  • Willful misconduct

  • Gross negligence where it cannot legally be excluded

  • Death or personal injury where liability cannot legally be excluded

  • A defective or materially misdescribed product

  • Breach of a mandatory consumer right

  • Any other liability that applicable law does not permit us to exclude

The existence of inherent risks in climbing does not excuse GripReady from obligations imposed by applicable product-safety or consumer-protection laws.

SECTION 27 – CUSTOMER RESPONSIBILITY AND INDEMNIFICATION

To the extent permitted by applicable law, you are responsible for losses or claims resulting directly from your:

  • Unlawful use of the website

  • Fraudulent conduct

  • Infringement of another person’s rights

  • Deliberate misuse of a product

  • Unauthorized commercial exploitation of website content

  • Material violation of these Terms

Where legally permitted, you agree to reimburse GripReady for reasonable losses arising directly from such conduct.

This section does not require a customer to indemnify GripReady for losses caused by GripReady’s own negligence, unlawful conduct, defective products, breach of contract, or violation of mandatory law.

SECTION 28 – EVENTS BEYOND REASONABLE CONTROL

GripReady will not be treated as having breached an obligation solely because performance was prevented or materially delayed by an event beyond our reasonable control, such as:

  • Natural disasters

  • Severe weather

  • Fire or flood

  • War or civil unrest

  • Public emergencies

  • Government action

  • Customs restrictions

  • Transportation interruption

  • Labor disruption

  • Carrier failure

  • Major system outage

  • Infrastructure failure

We will make reasonable efforts to communicate material delays and provide any cancellation, refund, or other remedy required by applicable law.

SECTION 29 – SUSPENSION AND TERMINATION

We may suspend or terminate website access, an account, or a pending transaction when reasonably necessary because of:

  • Material violation of these Terms

  • Suspected fraud

  • Security concerns

  • Illegal activity

  • Payment abuse

  • Threats or harassment

  • Repeated misuse of store services

Termination does not eliminate rights or obligations that arose before termination.

Sections that reasonably need to continue after termination, including payment obligations, intellectual property provisions, liability provisions, and dispute-related provisions, will remain effective to the extent permitted by law.

SECTION 30 – CHANGES TO THE WEBSITE AND TERMS

We may update the website, product selection, features, policies, or these Terms.

The current version will be posted on this page with an updated revision date.

Changes generally apply from the date they are posted and will not retroactively remove rights that already arose from a completed purchase unless:

  • Applicable law requires the change

  • The customer agrees to the change

  • The change benefits the customer

  • The change is administrative and does not materially reduce customer rights

Customers should review these Terms periodically.

SECTION 31 – SEVERABILITY

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply where legally permitted.

SECTION 32 – NO WAIVER

If GripReady does not immediately enforce a provision of these Terms, that does not permanently waive the right to enforce it later.

A waiver is effective only when clearly provided by an authorized representative and permitted by applicable law.

SECTION 33 – TRANSFER OF RIGHTS

Customers may not transfer contractual rights or obligations arising from an order to another person when the transfer would interfere with payment verification, fraud prevention, product restrictions, or legal obligations.

GripReady may transfer its rights or obligations as part of a lawful business transfer, restructuring, merger, asset sale, or service-provider arrangement, provided that the transfer does not unlawfully reduce existing customer rights.

SECTION 34 – ENTIRE AGREEMENT

These Terms, together with the policies and information expressly incorporated into them, form the agreement governing use of the GripReady website and purchases made through it.

If a product-specific written warranty, safety instruction, or separately agreed written term conflicts with a general provision of these Terms, the more specific term will apply to that issue, subject to mandatory law.

SECTION 35 – DISPUTES AND APPLICABLE RIGHTS

Customers should contact GripReady first when they believe an order, payment, product, return, or service issue has not been resolved.

Both parties should make reasonable efforts to resolve the issue through direct written communication.

Nothing in these Terms prevents a customer from:

  • Exercising a mandatory consumer right

  • Contacting a payment provider

  • Filing a complaint with an appropriate government authority

  • Using an available court or dispute-resolution procedure

  • Reporting a safety concern or suspected unlawful activity

The laws and mandatory consumer protections applicable to the seller, customer, transaction, and delivery destination will apply as determined by the appropriate authority.

No provision of these Terms requires a customer to waive a legal right that cannot lawfully be waived.

SECTION 36 – CONTACT INFORMATION

Questions regarding these Terms of Service should be sent to:

Store Name: GripReady
Website: gripready.com
Email: housbirdcempo@gmail.com

Email is our primary customer support channel.

When contacting us about an order, include your full name, order number, and a clear description of the issue.
